What are the expectations and legal certainties during this process? Last Thursday, former Ambassador Arturo Fermandois spoke with Luksic Scholars<strong> <\/strong>living around the world: Chile, France, Croatia, Germany, and the US, to provide us with the most important details on Chile&#8217;s constitutional process and the potential agenda if the drafting of a new constitution is approved. <\/span><\/p>\n\n\n\n<p><span class=\"ls-force-justify\">This masterclass-style event was divided into three topics: 1) the context of the constitutional process, 2) the steps, framework, and timeframe for this process, and 3) the legal certainties, challenges, and expectations.<\/span><\/p>\n\n\n\n<h4 class=\"has-text-color wp-block-heading\" style=\"color:#f85f3c\"><em><span class=\"ls-force-justify\">\u201cWe have a very important challenge here, of using and taking the energy that the country [Chile] is receiving and all the expectations that are there for a new constitution, and balancing that with some more difficult tasks, which is rescuing the many institutions\u2019 rights and mechanisms that have been in advancement for the past 15 to 20 years in the current Constitution\u2026\u201d<\/span><\/em><\/h4>\n\n\n\n<h4 class=\"wp-block-heading\">FIRST TOPIC: THE CONTEXT OF THE CONSTITUTIONAL PROCESS<\/h4>\n\n\n\n<p><span class=\"ls-force-justify\"><strong>\u201cIt started with civil unrest on October 18th, 2019<\/strong> with an underlying feeling that after a week of protests, a new constitution should be drafted. Until September 2019, the idea of having a new constitution was forgotten.<strong> <\/strong>We should remember that former President Michelle Bachelet wanted to start this process, and she did it, I was a part of it, however, the idea [of this] lost strength. At the end of that presidency, President Pi\u00f1era was elected and he didn&#8217;t propose a new constitution, so it\u2019s interesting to look at the ups and downs that a constitution could be a tool for a better country because that\u2019s not a logical answer all the time. It has ups and downs.<\/span><\/p>\n\n\n\n<p><span class=\"ls-force-justify\"><strong>By the middle of November 2019, there was a remarkable consent that a new constitution should at least be considered as an option.<\/strong> The social uprising led to a <em>constitutionalization<\/em> with high expectations of an outcome. It\u2019s a well-known political agreement for peace and a new constitution signed by bipartisan participation of political leadership in Congress, also what we call <em>el acuerdo de 15 de noviembre<\/em> (The November 15th Agreement). That agreement was to set the rulers and timeframe for the constitutional process.\u201d<\/span><\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>ARTURO&#8217;S EXPERIENCE BEING CALLED TO THE &#8220;TECHNICAL COMMISSION&#8221;<\/strong>:<\/h4>\n\n\n\n<p><span class=\"ls-force-justify\">\u201cBefore we look further into the timeline, <strong>I had the honor of being called<\/strong>, after the November 15th Agreement, <strong>to participate in what was called the \u201cTechnical Commission\u201d, which was made up of 14 constitutionalists<\/strong>. We worked for about three weeks, drafting the bill that had the amendment to the Constitution which would set up all the details of the process. It was a group of very talented scholars, but we felt very differently about the constitutional process. It was a very good experience because, at the beginning of these meetings, we felt we may not reach an agreement, but after two and a half weeks, we ended with what we felt was a proud result.&nbsp;<\/span><\/p>\n\n\n\n<p><span class=\"ls-force-justify\">We were able to reach agreements on the technicalities of the process, and I\u2019m going to share some of these with you. It will be very critical for this process moving forward, to be able to have some part of that environment [in the Technical Commission], be present during the constitutional convention.\u201d<\/span><\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>SECOND TOPIC: THE STEPS, FRAMEWORK, AND TIMEFRAME OF THE CONSTITUTIONAL PROCESS<\/strong><\/h4>\n\n\n\n<p><span class=\"ls-force-justify\">\u201cFollowing those two and a half weeks, the Technical Commission presented a draft which Congress easily approved and passed the constitutional amendment, which was officially enacted on December 24th, so on Christmas day we had a new picture moving forward.<\/span><\/p>\n\n\n\n<p><strong><span class=\"ls-force-justify\">What are the steps in the constitutional process?&nbsp;<\/span><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>The 1st referendum on October 25th, 2020<\/strong>: We\u2019ll start with the 1st referendum on October 25th. The first question here is: do we want a new Constitution or not? With the answer being yes or no. And secondly: who is going to be in charge of drafting this constitution if the answer is yes? There are two options here: 1) the first is through a Constitutional Convention entirely elected by the people, with an election system that is closely related to the Chamber today, or 2) a Mixed Convention, which is half elected by the people and the other half coming from Congress (making up current Congressman and Senators); proportionally representing the piece of the political pie in Congress. <strong><em>The numbers are 122 for a Constitutional Convention and 155 for a Mixed Convention. There are several questions today as to which is the best option.<\/em><\/strong><\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>If the drafting of a new constitution is approved, the next step will be on April 11th, 2021. <\/strong>A 9-month period (extendable to another 3 months) would begin in which the convention must discuss, draft, and propose a new constitution.<strong> <\/strong>This is not an easy task. We would need to write a constitution (if the choice approval wins), within just 9 months. This is important because there are automatic effects after this 9-month or 1-year period ends. If the convention drafts a new constitution it shall then be proposed to the President and the President must call for a 2nd referendum, in which the people will decide whether or not to approve this new constitution.&#8221;<\/li><\/ul>\n\n\n\n<h4 class=\"has-text-color wp-block-heading\" style=\"color:#f85f3c\"><em>\u201cIf the Constitutional Convention doesn\u2019t end up finalizing a draft for a new constitution, or if the 1st referendum results in a \u201cno\u201d [rejection of new constitution entirely], or, in a third case scenario, the 2nd referendum [in which the President presents the newly drafted constitution to the people] ends up in a \u201cno\u201d, then the current Constitution will remain in place &#8211; and that\u2019s an interesting point because it should work as an incentive for the different political forces to agree and compromise in terms of a written means to an end.\u201d<\/em><\/h4>\n\n\n\n<h4 class=\"wp-block-heading\">THIRD TOPIC: <strong>THE LEGAL CERTAINTIES IN THIS PROCESS, ANSWERS TO SOME OF THE CHALLENGES, AND THE EXPECTATIONS<\/strong><\/h4>\n\n\n\n<p><span class=\"ls-force-justify\">\u201cThere are some legal certainties that are going to be interesting over this period of two years, given that we may not see a new constitution until April or May of 2022. The legal certainties are:<\/span><\/p>\n\n\n\n<p><span class=\"ls-force-justify\"><\/span><\/p>\n\n\n\n<p><span class=\"ls-force-justify\"><strong>1. The Constitutional Convention [the body that would draft the new framework] has limited powers.<\/strong> These powers are exclusively to draft, discuss, and propose a draft of a new constitution. It\u2019s explicitly prohibited from them taking powers from other branches of government, as it has happened in other countries. We don\u2019t have an unlimited convention &#8211; it is called for a specific task. <\/span><\/p>\n\n\n\n<p><span class=\"ls-force-justify\">It [the Constitutional Convention] cannot interfere with the power in other branches of government and it cannot change the codes that are set in the rules approved by the Constitution, which has happened in other countries going through a constitutional process. If rules are broken, then there will be a special court to evaluate and solve that. The court would be formed by five (5) justices of the Supreme Court. When deciding this in the Technical Commission, we all agreed that this was good because we need a clear and transparent process.<\/span><\/p>\n\n\n\n<p><span class=\"ls-force-justify\"><strong>2. As stated in the current Constitution, a new constitution must respect and maintain the following concepts<\/strong>:<\/span><\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>The republic (as it\u2019s the Republic of Chile),<\/li><li>The democratic system,<\/li><li>The international treaties that are already signed by Chile and are put in place today, and<\/li><li>The judicial decisions that are already delivered.<\/li><\/ol>\n\n\n\n<p><span class=\"ls-force-justify\"><strong>In terms of expectations, challenges, and changes: the first is the management of public order in order to maintain a peaceful life. <\/strong>When or if the convention will be deciding and discussing, there needs to be a high level of peace, otherwise, the new constitution may have a mark of illegitimacy.<\/span><\/p>\n\n\n\n<p><span class=\"ls-force-justify\"><strong>Another challenge will be agreeing on the rulers under which the new constitution is going to work.<\/strong> Today\u2019s Constitution says that the provisions of a new constitution should be approved by 2\/3rds of the Constitutional Convention, however, there\u2019s a big discussion as to what those 2\/3rds of the convention means. It\u2019s a big topic and is not solved today, but it\u2019s the first step if this [first referendum] proceeds.<\/span><\/p>\n\n\n\n<p><span class=\"ls-force-justify\"><strong>What will be the changes, the amendments, in the constitutional agenda?<\/strong> There\u2019s a consensus amongst the idea that the subsidiary government or State should be revised or changed by a social and democratic state as a declaration. This is a common consensus among academia and politics, yet everyone may have their own opinion.<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>The empowerment of social rights will probably be on the agenda, and the strengthening of the State to regulate activities.<\/li><li>A constitutional court<strong> <\/strong>has also been on the agenda and reducing some of its powers.<\/li><li>Another idea is<strong> <\/strong>strengthening the decentralization of the country and perhaps some discussion on natural resources (mining and rights over water).<\/li><\/ul>\n\n\n\n<h4 class=\"has-text-color wp-block-heading\" style=\"color:#f85f3c\"><em>&#8220;As a country, we need to take these new ideas, and the new, fresh air that we see in young generations &#8211; generations that were born in a country that has had an incredible developing period with impressive advances in the fight against poverty, infrastructure, and also, in equality &#8211; to a new constitution and mix and balance those with what\u2019s good in the constitutional framework.\u201d<\/em><\/h4>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<p><span class=\"ls-force-justify\">This event is part of our three-part series: \u201cThe Chilean Plebiscite told from 3 Perspectives: Constitutional, Cultural, and Economic\u201d.
